DUI and Drink Driving Charges

For people on learner, probationary and provisional licences, there is a zero-alcohol limit in Queensland. There are other licence categories in Queensland that have the same limit. For a first offence in this category, the following applies:

  • Licence Disqualification: Between 3 to 9 months.
  • Maximum Fine Amount: 14 penalty units. From 1 July 2019, each penalty unit is set at a value of $133.45. So the maximum penalty is a little over $1,800.
  • Maximum Term of Imprisonment: 3 months imprisonment.

For a first offence in this category, the following applies:

  • Licence Disqualification: Between 1 to 9 months.
  • Maximum Fine Amount: 14 penalty units. From 1 July 2019, each penalty unit is set at a value of $133.45. So the maximum penalty is a little over $1,800.
  • Maximum Term of Imprisonment: 3 months imprisonment.

For a first offence in this category, the following applies:

  • Licence Disqualification: Between 3 to 12 months.
  • Maximum Fine Amount: 20 penalty units. From 1 July 2019, each penalty unit is set at a value of $133.45. So the maximum penalty is a little under $2,700.
  • Maximum Term of Imprisonment: 6 months imprisonment.

For a first offence in this category, the following applies:

  • Licence Disqualification: Minimum disqualification of 6 months.
  • Maximum Fine Amount: 28 penalty units. From 1 July 2019, each penalty unit is set at a value of $133.45. So the maximum penalty is a little over $3,700.
  • Maximum Term of Imprisonment: 9 months imprisonment.

Court Proceedings

Many people who drive while over the legal alcohol limit feel that they were ‘alright to drive’.

In Queensland, there is a defence of having an honest and reasonable but mistaken belief as to the existence of something that turns out to be untrue but that contributed to your decision-making. That defence does not apply to drink driving charges in Queensland. By limiting that defence, there are very few ways by which a person can successfully defend a charge.
